Step 1 — What Type of Record Do You Have?

Georgia’s record restriction law covers different situations. Check which applies to you:

  • Arrest with no conviction — charges were dropped, dismissed, or you were found not guilty
  • First Offender Act sentence — you were sentenced under the First Offender Act and successfully completed probation
  • Certain misdemeanor convictions — some misdemeanors may qualify after a waiting period
  • Felony conviction — most felony convictions do not qualify for record restriction, but may qualify for a pardon or gun rights restoration

If you were arrested but not convicted, you likely qualify if:

  • ✓ You do not have more than 2 prior criminal convictions on your record

  • ✓ You have been discharged by the court
  • ✓ Your offense was not a serious violent felony or sex offense
